If you change the story by more than 15-20%, you don't have to do anything for the old writer. However, you DO open the door for a lawsuit. I would do the "Based on a story by ..." and agree with the new writer what you will pay the writers of the original story. The best advice is to get legal advice.

Hello, I have a question.

Sometime ago a friend and I wrote an screenplay. My characters and core story, collaborative effort 50/50 on the screen play. The script generally blew chunks BUT there were some salvageable moments.

SO,... I and a new writer wrote a completely new version utilizing some pages/ideas/elements from the original script that I and my initial friend wrote some years ago.

My question is this:

Should the BY line read "written by New writer and me WITH old writer" OR "written by New writer and me AND old writer"

Or is there something else that I haven't thought of.
